In order to further standardize the management of gas operation licenses in our province and promote the healthy development of the gas industry, our department has revised the "Implementation Measures for Gas Operation Licenses in Hebei Province". It is now issued to you. Please strictly abide by and implement it.

Implementation Measures for Gas Business License in Hebei Province

 

Article 1 This measure is formulated in accordance with the "Regulations on Gas Management of Hebei Province", the "Measures for the Administration of Gas Operation Permits" issued by the Ministry of Housing and Urban-Rural Development, and in light of the actual situation in our province, to standardize the behavior of gas operation permits and strengthen the management of gas operation permits.

 

Article 2 Any entity engaged in gas business operations shall obtain a gas business operation license and operate within the scope of the license.

 

The application, acceptance, examination and approval, issuance of certificates and related supervision and management of gas operation licenses shall be governed by these Measures.

 

The production and import of natural gas and liquefied petroleum gas, the transportation of natural gas through pipelines outside gate stations, the use of gas as raw materials for industrial production, and the production and use of biogas and straw gas are not subject to these measures.

 

Article 3 The Department of Housing and Urban-Rural Development of the Province is responsible for the supervision and administration of gas operation licenses throughout the province.

 

The gas operation license approval departments determined by the people's governments of cities divided into districts (including Dingzhou and Xinji cities) and the Administrative Committee of Xiongan New Area (hereinafter referred to as "local gas operation license approval departments") are responsible for the gas operation license approval work within their respective administrative regions in accordance with their authority. The gas management departments are responsible for the supervision and management work after the gas operation license approval within their respective administrative regions.

 

Article 4 The categories of gas operation are divided into five types: pipeline gas, bottled gas, affiliated gas filling stations of expressway service areas, gas vehicle gas filling stations (mother stations and child stations), and other operation types.

 

Those engaged in the operation of affiliated gas stations in expressway service areas shall apply to the Provincial Department of Housing and Urban-Rural Development for the issuance of a gas operation license.

 

Those engaged in pipeline gas, bottled gas, gas vehicle refueling stations (mother stations, child stations), and other business operations shall apply to the local gas operation license approval department for the issuance of a gas operation license.

 

The gas operation license approval departments at all levels shall, within 5 working days from the date of issuance of the license, inform the gas management department at the same level of the issuance situation. The gas management department at the same level shall report the issuance situation to the superior gas management department and inform the subordinate gas management department.

 

Article 5 The following conditions shall be met for engaging in gas business activities:

 

(1) Obtain a business license.

 

(2) Comply with the requirements of the gas development plan.

 

The gas operation area, types of gas sources, supply methods and scales, layout and construction sequence of gas facilities, etc. shall comply with the gas development plan approved in accordance with the law.

 

(3) There is a gas source that meets national standards.

 

1. A gas supply and use contract should be signed with the gas source supply enterprise.

 

2. The composition, calorific value and pressure of the supplied gas and other indicators shall comply with the relevant national regulations.

 

(4) It has gas facilities that meet national standards.

 

It has facilities and equipment for gas production, storage, transmission and distribution, supply, measurement, safety, etc. that comply with national standards.

 

2. The construction of gas facilities projects complies with legal procedures, passes the completion acceptance inspection and is legally filed, etc.

 

(V) Have a fixed business location.

 

It has a fixed office location, business and service stations, etc.

 

(6) It has a complete safety management system and a sound business plan.

 

The safety management system mainly includes: the safety production responsibility system, the safety inspection and testing system for facilities and equipment (including user facilities), the gas quality testing system, job operation procedures, the emergency response plan for gas incidents, and the gas safety publicity system, etc.

 

The business plan mainly includes: the company's articles of association, development plan, engineering construction plan, user development business process, fault reporting and repair, complaint handling, quality assurance and safe gas usage service system, etc.

 

(7) The principal person in charge of the enterprise, safety production management personnel, as well as operation, maintenance and emergency repair personnel have received training and passed the assessment of the gas management department. Professional training and assessment shall be carried out in accordance with the "Administrative Measures for Professional Training and Assessment of Employees of Gas Operating Enterprises" issued by the Ministry of Housing and Urban-Rural Development.

 

The number of personnel who have received professional training and passed the assessment should be commensurate with the scale of the enterprise's operation. The minimum number of personnel should meet the following requirements:

 

The principal person in charge of the enterprise. It refers to the legal representative of an enterprise and the chairman (executive director) and manager who do not serve as the legal representative.

 

2. Safety production management personnel. It refers to the person in charge of safety production in an enterprise, the person in charge of the enterprise's production and safety management departments, the person in charge of the enterprise's production and sales branches, as well as the full-time safety officer of the enterprise and other relevant management personnel.

 

3. Operation, maintenance and emergency repair personnel. It refers to the operators responsible for the operation, maintenance and emergency repair of gas facilities and equipment, including but not limited to gas transmission and distribution station workers, liquefied petroleum gas depot station workers, compressed natural gas station workers, liquefied natural gas storage and transportation workers, vehicle refueling station operators, gas pipeline network workers, gas user maintenance workers, and bottled gas delivery workers. The minimum number of people should meet:

 

For pipeline gas operation enterprises with a planned supply capacity of less than 100,000 households, there should be no less than one person for every 2,500 households. For every additional 2,500 households with more than 100,000 households, one more person will be added. Among them, the proportion of gas user maintenance workers is 20% to 40%.

 

For bottled gas operation enterprises, there should be no less than 3 people who plan to supply 1,000 or fewer users. For households with more than 1,000 but less than 10,000, there is one person for every 800 households. For every additional 10,000 households, an additional 10 people will be added. For every additional 10,000 households, an additional 8 people will be added. For every additional 10,000 households over 100,000, an additional 5 people will be added. Among them, the proportion of bottled gas delivery workers is 20% to 40%.

 

The mother station for gas vehicle refueling should have no less than 8 people per seat, the sub-station for gas vehicle refueling should have no less than 5 people per seat, the affiliated refueling station of expressway service areas should have no less than 5 people per seat, and other business types should have no less than 10 people.

 

(8) Other conditions as prescribed by laws and regulations.

 

Article 6 When applying for a gas operation license, the following materials shall be submitted and the applicant shall be responsible for their authenticity, legality and validity:

 

(1) Application for Gas Business License;

 

(2) Business license (If the approval department has the conditions for online verification, the applicant may not provide it);

 

(3) Explanation of the enterprise's capital structure;

 

(4) Certificates of qualification for the main person in charge of the enterprise, safety production management personnel, as well as operation, maintenance and emergency repair personnel, etc.

 

(5) Property rights certificates or lease agreements for fixed business premises (including office premises, business and service stations, etc.);

 

(6) Filing documents for the completion acceptance of gas projects;

 

(7) Gas quality detection report and gas supply and use contract signed with gas source supply enterprise;

 

(8) Materials on the complete safety management system and sound business plan as required by item (6) of Article 5 of these Measures.

 

In addition to meeting the conditions stipulated in the preceding paragraph, pipeline gas operation enterprises shall also provide the franchise agreement signed with them by the relevant departments authorized by the people's government of the prefecture-level city (including the Administrative Committee of Xiongan New Area) and the people's government of the county (city, district).

 

Article 7 The Department of Housing and Urban-Rural Development of the Province and the local gas operation license approval departments shall review the application materials of the applicants through material examination and on-site verification, and make a decision on whether to grant the license within 10 working days from the date of accepting the application. If a licensing decision cannot be made within 10 working days, with the approval of the person in charge of the gas operation licensing approval department, the period may be extended by 10 working days, and the reasons for the extension shall be informed to the applicant.

 

Where the provincial Department of Housing and Urban-Rural Development or the local gas operation license approval departments make a decision not to grant the license, they shall explain the reasons for the non-grant and inform the applicant of their right to apply for administrative reconsideration or file an administrative lawsuit in accordance with the law.

 

Article 8 The decisions on granting licenses made by the Provincial Department of Housing and Urban-Rural Development and the local gas operation license approval departments shall be made public, and the public has the right to inquire.

 

The disclosed information includes: the name of the gas operation enterprise approved for licensing, license number, registered address, main person in charge of the enterprise, business category, business area, licensing authority, date of issuance and validity period of the license, etc.

 

Article 9 The Department of Housing and Urban-Rural Development of the Province is responsible for formulating the unified rules for the numbering of gas operation licenses throughout the province. The gas operation license shall be numbered in accordance with the numbering rules (see the attachment).

 

Article 10 Where a gas operation enterprise that has obtained a gas operation license needs to change its enterprise name, registered address or the main person in charge of the enterprise, it shall apply for a change of the gas operation license. Where the main person in charge of the enterprise is to be changed, the new main person in charge of the enterprise shall have a certificate of qualification for the assessment of gas practitioners. Without permission, the licensed matters shall not be changed at will.

 

Article 11 A gas operation enterprise that has obtained a gas operation license shall reapply for the operation license if it has any of the following circumstances.

 

(1) Where the business category, business area, supply mode, etc. of a gas operation enterprise change;

 

(2) Where a gas operation enterprise undergoes division or merger.

 

Article 12 If a gas operation enterprise loses its gas operation license, it shall declare it invalid in a publicly issued newspaper or periodical and apply for a replacement. The Department of Housing and Urban-Rural Development of the Province and the local gas operation license approval departments shall publish a free announcement of the loss on their official websites and verify and reissue the gas operation license within 5 working days.

 

If the surface of the gas operation license becomes dirty, damaged or the content of the gas operation license cannot be identified for other reasons, an application for a replacement should be made. The Provincial Department of Housing and Urban-Rural Development and the local gas operation license approval departments shall recover the original gas operation license and verify and reissue it within 5 working days.

 

Article 13 The validity period of the gas operation license is five years. If an application for renewal is made upon expiration, the application shall be submitted 30 days before the expiration date along with the following application materials, and the applicant shall be responsible for their authenticity, legality and validity:

 

(1) Application for Extension of the Validity Period of the Gas Business License;

 

(2) Professional training and assessment qualification certificates for the main person in charge of the enterprise, safety production management personnel, as well as operation, maintenance and emergency repair personnel, etc.

 

(3) Gas Operation License.

 

Article 14 The Department of Housing and Urban-Rural Development of the Province and the local gas operation license approval departments may revoke the gas operation license that has been issued under any of the following circumstances:

 

(1) Where the staff members of the licensing authority abuse their power, neglect their duties and illegally issue gas operation licenses;

 

(2) Where a staff member of the licensing authority issues a gas operation license beyond the legal authority;

 

(3) Where the staff members of the licensing authority issue gas operation licenses in violation of the legal procedures;

 

(4) Issuing a gas operation license to an applicant who does not have the application qualifications or does not meet the legal conditions;

 

(5) Where a gas operation enterprise obtains a gas operation license through improper means such as fraud or bribery;

 

(6) Other circumstances where the gas operation license may be revoked in accordance with the law.

 

Article 15 Where any of the following circumstances occurs, the Department of Housing and Urban-Rural Development of the Province and the local gas operation license approval departments shall handle the cancellation procedures of the gas operation license in accordance with the law:

 

(1) The validity period of the gas operation license has expired and the gas operation enterprise has not applied for renewal;

 

(2) The subject qualification of the gas operation enterprise is lawfully terminated;

 

(3) The gas operation license has been lawfully revoked or withdrawn, or the gas operation license has been lawfully withdrawn;

 

(4) Where the implementation of the gas operation license matters is prevented due to force majeure;

 

(5) Other circumstances where the gas operation license should be revoked in accordance with the law.

 

Article 16 Where a gas operation enterprise applies for the cancellation of its gas operation license, it shall submit the following application materials:

 

(1) Application for Cancellation of Gas Business License;

 

(2) Relevant plans of the gas operation enterprise for the resettlement of existing users and the disposal of facilities, etc.

 

(3) Gas Operation License;

 

(4) Materials related to the cancellation of the gas operation license as stipulated by laws, regulations and rules.

 

After accepting the application for cancellation, the provincial Department of Housing and Urban-Rural Development and the local gas operation license approval departments shall, upon review, lawfully cancel the gas operation license.

 

Article 17 Gas management departments at all levels shall, in conjunction with relevant departments, strengthen mid - and post-event supervision of gas business operations through means such as information disclosure, spot checks, and random inspections, and by comprehensively applying methods such as reminders, interviews, and warnings. Gas business enterprises shall actively cooperate.

 

From January 1st to March 31st each year, gas management departments at all levels shall carry out annual supervision and inspection work on gas operation enterprises that have obtained gas operation licenses. Gas operation enterprises shall proactively submit their annual reports of the previous year to the gas management departments. The main contents of the annual reports of enterprises include:

 

(1) The articles of association of the enterprise and the capital structure of the enterprise and their changes;

 

(2) Changes and training situations of the main person in charge of the enterprise, safety production management personnel, as well as operation, maintenance and emergency repair personnel, etc.

 

(3) Specific circumstances of the enterprise's construction and renovation of gas facilities;

 

(4) The operation of the enterprise, including supply scale, user development, system establishment, inspection and patrol, household safety inspection, emergency rescue and repair, emergency drills, etc.

 

(V) Enterprise service situation, including the establishment of service Windows, problem complaints, repair reporting and handling, gas installation application services, etc.

 

(6) Other contents that need to be reported.

 

Article 18 The Department of Housing and Urban-Rural Development of the Province shall establish a joint punishment mechanism for untrustworthiness of gas operation enterprises throughout the province and uniformly manage the public disclosure of credit information. Gas management departments at all levels should, in conjunction with gas operation license approval departments and law enforcement departments, implement a joint punishment mechanism, and lawfully impose punitive measures such as revocation, cancellation, and revocation of operation licenses on gas enterprises that operate illegally, and include them in the list of enterprises with abnormal operations and the "blacklist".

 

Where the relevant law enforcement department lawfully revokes the gas operation license of a gas operation enterprise, it shall transfer the case to the gas operation license approval department. The gas operation license approval department shall handle the cancellation procedures of the gas operation license within 5 working days in accordance with the law.

 

Article 19 The gas operation license approval departments at all levels shall use the provincial unified gas operation license management information system, which includes the issuance, modification, withdrawal, revocation, cancellation and revocation of gas operation licenses, etc. Promote information sharing and application among departments, strengthen interdepartmental and regional collaboration, and enhance the level of information management.

 

Article 20 Where the department in charge of the administration of gas operation licenses and its staff fail to perform their duties in accordance with these Measures, the superior administrative organ or the supervisory organ shall order them to make corrections. Where the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the law. If a crime is constituted, criminal responsibility shall be pursued in accordance with the law.

 

Article 21 This measure shall come into effect on April 1, 2025 and remain valid for two years. The "Implementation Measures for Gas Business License in Hebei Province" (Ji Jian Fa Gai [2020] No. 3) issued by the Department of Housing and Urban-Rural Development of Hebei Province on March 28, 2020, is simultaneously abolished.
