Notice on Amending the "Measures for the Administration of Credit Evaluation of Construction Enterprises in Hebei Province

The newly revised "Measures for the Administration of Credit Evaluation of Construction Enterprises in Hebei Province" has been deliberated and approved at the first departmental executive meeting in 2025. It is hereby issued and shall come into effect as of April 1, 2025.

Measures for the Administration of Credit Evaluation of Construction Enterprises in Hebei Province
Article 1: To improve the credit system of the construction market and standardize the management of the construction market In accordance with documents such as the "Opinions of the Central Committee of the Communist Party of China and The State Council on Accelerating the Construction of a National Unified Market", the "Guiding Opinions of The General Office of the State Council on Accelerating the Construction of the Social Credit System and Building a New Regulatory Mechanism Based on Credit", and the "Decision of the Standing Committee of the People's Congress of Hebei Province on Strengthening the Supervision and Administration of the Construction Market", and in light of the actual situation in our province, this method is formulated.
Article 2 This measure shall apply to the credit evaluation work of construction enterprises (excluding enterprises with construction labor qualifications) engaged in housing construction and municipal engineering project construction activities within the administrative region of this province.
Article 3 The provincial housing and urban-rural development department is responsible for the credit evaluation management of construction enterprises throughout the province, formulates the evaluation management measures and implements them.
The housing and urban-rural development departments of cities, counties (districts) are responsible for the specific implementation of the credit evaluation of construction enterprises within their respective administrative regions or the application of the evaluation results.
Construction enterprises submit relevant information on credit evaluation through the "Hebei Province Construction Market Supervision Public Service Platform". After review, the credit evaluation score is calculated based on the credit evaluation standards for construction enterprises in Hebei Province (Attachment 1). Some information is automatically obtained through the data of the shared industry management information system.
Article 4 The credit evaluation work for construction enterprises shall follow the principles of legality, openness, fairness and impartiality.
Article 5 The provincial housing and urban-rural development department shall establish a unified credit evaluation system throughout the province and conduct dynamic evaluations of the credit status of construction enterprises in accordance with these Measures.
Article 6 The credit evaluation benchmark for construction enterprises is 60 points, with a full score of 100 points and a minimum score of 0 points. The evaluation content includes project credit information, enterprise credit information and administrative penalty information.
Project credit information includes performance information and negative information of the project. Enterprise credit information includes good information and negative information of the enterprise. Administrative penalty information includes administrative penalty information received by the enterprise and the projects it undertakes. For specific contents, please refer to the credit evaluation standards.
Article 7 Credit information includes the following contents:
(1) Project performance information. It mainly reflects the enterprise's quality and safety control level and performance capacity of the project, including: project quality and safety, demonstration projects, and green building labels, etc.
(II) Project Negative Information. It mainly reflects the information of illegal and non-compliant activities existing in the implementation of projects by enterprises, including: administrative penalties received by ongoing projects due to illegal and non-compliant activities, mass visits and lawsuits or social public opinions caused by project arrears of migrant workers' wages, refusal or obstruction of supervision, inspection and law enforcement, refusal to fulfill administrative penalty decisions, and failure to cooperate with dispute mediation, etc.
Article 8 Enterprise credit information includes the following contents:
(1) Good enterprise information. It mainly reflects information such as the enterprise's good social reputation related to the housing construction and municipal engineering industry, including: the enterprise has received honors, the enterprise has been commended for fulfilling social responsibilities, etc.
(II) Negative information of enterprises. It mainly reflects negative information of the enterprise other than the implementation of engineering projects, including: administrative penalties received by the enterprise due to violations of laws and regulations, providing false materials to administrative authorities, failing to fulfill written commitments made to administrative authorities, being included in the list of construction market entities or seriously untrustworthy entities subject to joint disciplinary actions for wage arrears to migrant workers, etc.
Article 9 Administrative penalty information includes the following contents:
(1) Serious acts of bad faith. This includes administrative penalties for behaviors such as subcontracting or illegal subcontracting, affiliation or lending of qualifications, occurrence of major or above construction safety accidents, major or above engineering quality accidents, and collusive bidding.
(2) General acts of bad faith. Including: The acts of undertaking projects without obtaining a construction permit, general construction safety accidents, general engineering quality accidents, construction in violation of mandatory standards for construction projects, bidding in the name of others or winning the bid by other means of fraud, obtaining enterprise qualifications or safety production licenses by using false materials and deceptive means, and undertaking projects beyond the scope of qualifications, etc Received administrative penalties.
Article 10 Housing and urban-rural development departments at all levels shall be responsible for the collection and entry of credit information in accordance with the principle of "whoever supervises is responsible, and whoever generates is responsible for collection".
(1) Provincial housing and urban-rural development departments collect and enter the following information generated by provincial-level or higher Party and government organs, housing and urban-rural development departments, emergency management departments or industry social organizations:
1. Information related to commendations, honors, etc. in the housing construction and municipal engineering industry. The specific categories of commendations by industry social organizations can be found in the national and provincial honor information included in the scoring scope (Annex 2).
2. Information on commendations and rewards received by the enterprise in major national events.
3. Information on smart construction sites, demonstration projects, green buildings, administrative handling, administrative penalties, etc.
4. Information on commendations and rewards received by enterprises for their participation in the construction of emergency rescue, disaster relief, epidemic prevention and other projects, as well as for the construction of housing and municipal engineering projects they have assisted in.
5. Information such as being listed as a professional emergency rescue team for housing construction and municipal engineering.
6. Information on the on-duty status of project managers, technical directors, quality directors, full-time safety production management and construction personnel during on-site inspections.
7. Information on commendations, rewards, etc. recognized by other provinces and cities.
(2) The municipal housing and urban-rural development department collects and enters the following information generated by the municipal (including Dingzhou City, Xinji City, and Xiongan New Area) Party and government organs, housing and urban-rural development departments, and emergency management departments:
Information such as enterprise commendations and honors related to the housing construction and municipal engineering industry;
2. Information on smart construction sites, demonstration projects, green buildings, payment guarantees and process settlements, administrative handling, administrative penalties, etc.
3. Information on commendations received by enterprises for their participation in the construction of emergency rescue, disaster relief and epidemic prevention projects, as well as for the construction of housing and municipal engineering projects they have assisted in.
4. Information such as being listed as a professional emergency rescue team for housing construction and municipal engineering.
5. Information on the on-duty status of project managers, technical directors, quality directors, full-time safety production management and construction personnel during on-site inspections.
(3) The project quality and safety assessment, the on-duty rate of key project personnel, as well as the negative information of the project and the enterprise, shall be collected by the credit evaluation system from the relevant industry supervision systems of the department.
Article 11 The relevant departments shall, in accordance with the duties stipulated in these Measures, verify the good credit information applied for by enterprises and promptly enter the information that meets the requirements into the credit evaluation system.
Article 12 The validity period for the use of information collected by the credit evaluation system shall be implemented in accordance with the following provisions:
(1) The following information shall be valid for 24 months from the effective date of the evaluation:
Be included in the list of construction market entities or those that seriously default on migrant workers' wages and are subject to joint disciplinary actions.
(2) The following information shall be valid for 12 months from the effective date of the evaluation:
1. Information such as commendations and honors received by the enterprise.
2. Information on smart construction sites, demonstration projects, green buildings, payment guarantees and process settlements.
3. Information on commendations received by enterprises for their participation in the construction of emergency rescue, disaster relief and epidemic prevention projects, as well as for the construction of housing and municipal engineering projects they have assisted in.
4. Information such as being listed as a professional emergency rescue team for housing construction and municipal engineering.
5. Information about projects that have triggered mass visits and lawsuits or public opinions due to the delay in payment of construction funds, refuse or obstruct supervision, inspection and law enforcement, refuse to comply with administrative penalty decisions or handling opinions, and do not cooperate with the mediation of construction fund disputes.
6. Information on enterprises providing false materials to administrative authorities, failing to fulfill written commitments made to administrative authorities, etc.
7. Information on administrative penalties received by the project or enterprise.
(3) The following information shall be evaluated and used for a period of 6 months from the date of its generation:
Project safety information.
2. Administrative processing information received by the project or enterprise.
(4) The following information shall be evaluated and used for a period of three months from the date of its generation:
1. Project quality information.
2. Information on the on-duty performance of key project personnel.
(5) Repaired bad credit information and administrative penalty information, as well as administrative penalties that have been revoked in accordance with legal procedures, will no longer be included in the evaluation scope.
Article 13 Credit evaluation shall be subject to dynamic management, with data updated once a day. The credit evaluation system calculates and publishes the credit evaluation results at 0:00 every day in accordance with the credit evaluation standards. The official website of the Provincial Department of Housing and Urban-Rural Development provides query services.
Article 14 The results of credit evaluation shall be applied to the bidding and tendering activities of housing construction and municipal engineering projects within the administrative region of this province.
The use of credit evaluation results is encouraged. The tenderer shall determine on its own whether to apply them in the bidding and tendering process based on the specific circumstances of the project. For bidding projects that use evaluation results, the proportion should be selected and determined within the range of the credit weight limit values for bidding and tendering of construction projects of different scales (Annex 3), with the maximum not exceeding 10%.
Article 15 If a construction enterprise has objections to the information used in the credit evaluation system, it may submit a written appeal to the department responsible for collecting and entering such information, along with relevant supporting materials. If the housing and urban-rural development department responsible for collecting and entering such information verifies the information to be true, it shall promptly make corrections.
Where the objection information mentioned in the preceding paragraph is obtained by the credit evaluation system through information sharing from the relevant regulatory system of the department, the construction enterprise shall file a complaint with the department responsible for the system.
Article 16: Construction enterprises that have no record of bad behavior within one year and have an evaluation score of no less than 95 points are classified as Class A enterprises. An incentive mechanism will be implemented to actively support their transformation and upgrading as well as high-quality development, and encourage them to grow stronger and larger.
(1) A green channel system shall be implemented in the process of handling the procedures for engineering project construction and various administrative approval matters to accelerate the processing progress.
(2) Priority will be given to recommending applications for outstanding engineering projects, construction methods, patents, and advanced enterprises at the ministerial, provincial, and municipal levels.
(3) Reduce the frequency of supervision and inspection of construction enterprises.
Article 17: Construction enterprises that have no less than five (including five) records of general untrustworthiness within one year, have not caused serious consequences, and have an evaluation score of no less than 75 points are classified as Class B enterprises and are subject to normal supervision.
Article 18: Construction enterprises that have more than five records of general bad behavior or serious records of bad faith within one year, or have an evaluation score of less than 75 points, shall be classified as Class C enterprises. The frequency of supervision and inspection shall be increased, and they shall be subject to key supervision and inspection. If necessary, they shall be included in the key supervision objects of special inspections.
Article 19 The provincial housing and urban-rural development department shall assess the use of credit evaluation results from time to time, and adjust this measure in a timely manner based on the credit of construction market entities and the standardization of market order.
Article 20 Where credit evaluation management personnel are derelict in their duties, abuse their powers or show favoritism and malpractice in the implementation of evaluations, they shall be given administrative sanctions by their units or the competent departments at a higher level in accordance with the law. If suspected of constituting a crime, the case shall be transferred to the judicial authorities for legal handling.
Article 21 This measure shall come into effect on April 1, 2025 and remain valid for five years. The "Measures for the Administration of Credit Evaluation of Construction Enterprises in Hebei Province" (Ji Jian Shi GUI Ban [2024] No. 1), which came into effect on August 1, 2024, is simultaneously abolished.
