Measures for the Administration of Credit Information of the Housing and Urban-Rural Development Industry in Hebei Province
Chapter One General Provisions
Article 1 This measure is formulated to strengthen the credit system construction of the housing and urban-rural development industry throughout the province, create an honest and trustworthy market environment, and promote the healthy development of the industry.
Article 2 This measure shall apply to the collection, recording, repair, inquiry, use and management of credit information of credit subjects in the housing and urban-rural construction industry within the administrative region of this province, as well as the construction of credit archive databases and information systems.
Article 3 The credit information of the housing and urban-rural construction industry (hereinafter referred to as "credit information") as used in these Measures refers to the records reflecting the compliance with laws and regulations, performance of duties and responsibilities, and contribution to society of credit subjects in the housing and urban-rural construction industry in their industry behaviors.
The term "credit subject of the housing and urban-rural construction industry" (hereinafter referred to as "industry credit subject") as used in these Measures refers to enterprises and registered practitioners engaged in the industries of survey and design, real estate, construction, maintenance and operation of municipal public facilities, and supply of building materials and equipment within the administrative region of this province.
The enterprise categories are classified in accordance with the "National Economic Industry Classification Standard GB/T4754-2017".
Article 4 The collection, recording and use of credit information shall ensure the authenticity and completeness of the information data, follow the principles of legality, objectivity, fairness and prudence, and keep state secrets, business secrets and personal privacy in accordance with the law.
Article 5 The Department of Housing and Urban-Rural Development of the Province is responsible for the credit information management of the housing and urban-rural development industry throughout the province. The main responsibilities are as follows:
(1) Formulate a unified provincial management system for the collection, recording, repair, inquiry and use of credit information, as well as a directory of the scope of credit information behavior records and credit evaluation standards, and supervise their implementation;
(2) Build and manage a unified provincial credit information system and credit archive database;
(3) Establish a credit information sharing mechanism with the competent department of housing and urban-rural development under The State Council and the relevant competent departments of this province;
(4) In accordance with the industry management authority, be responsible for the collection, recording and use of relevant credit information;
(V) Guide the credit information management work of all departments of the lower-level housing and urban-rural development system.
Article 6 The departments of the housing and urban-rural development systems of cities divided into districts and counties (cities) shall respectively be responsible for the management of credit information in their respective industries within their administrative regions. The main responsibilities are as follows:
(1) Implement and enforce the unified credit information management system throughout the province;
(2) Do relevant work in accordance with the requirements for establishing a unified credit information system and credit archives throughout the province;
(3) In accordance with the industry classification management authority and the provisions of these Measures, be responsible for the collection, recording and use of relevant credit information;
(4) Undertake other credit information management tasks assigned by superiors.
Chapter Two Credit Information Classification
Article 7 Credit information is divided into basic information, good behavior information and bad behavior information.
Article 8 Basic information includes basic information of enterprises (units) and basic information of personnel.
The basic information of an enterprise (unit) mainly includes the following contents:
(1) Enterprise (unit) identity information, including name, registered address, office location, legal representative's name, etc.
(2) Qualification and license information, including grade, validity period and supervision and inspection records, etc.
(3) Other basic information determined by the Provincial Department of Housing and Urban-Rural Development.
The basic information of registered practitioners mainly includes the following contents:
(1) Personal identity information, including name, gender, date of birth, work unit, etc.
(2) Qualification information, including qualification category, level, certificate number, validity period and supervision and inspection record information, etc.
(3) Other basic information determined by the Provincial Department of Housing and Urban-Rural Development.
Article 9 Good behavior information refers to the information on how an industry credit subject, when engaged in the production and operation of the construction industry and participating in other activities of the construction industry, acts in accordance with laws and regulations, behaves in a standardized manner, strictly fulfills social responsibilities and obligations, and has been commended, rewarded, or awarded advanced titles by the people's government at or above the county level, the industry's competent department, or industry social organizations, as well as social public welfare behaviors.
Article 10 Information on adverse conduct refers to the information on administrative penalties and administrative handling received by industry credit subjects for failing to comply with or violate relevant laws, regulations, rules, mandatory standards for engineering construction, and professional conduct norms when engaging in the production and operation of the construction industry or participating in other activities of the construction industry.
Article 11 Good behavior information and bad behavior information shall be recorded in accordance with the credit behavior scope directory formulated by the Provincial Department of Housing and Urban-Rural Development.
Housing and urban-rural development authorities at or above the county level shall, in accordance with the unified standards of the province, strengthen the constraints and joint punishment on seriously untrustworthy entities.
Article 12 The Department of Housing and Urban-Rural Development of the Province shall, in accordance with the characteristics of the industry and management needs, conduct credit evaluations based on the principle of "who uses, who evaluates", in combination with the application fields.
Encourage third-party institutions to conduct credit evaluations by using the information of the housing and urban-rural construction industry throughout the province.
Chapter Three: Collection and Recording of Credit Information
Article 13 Collection and Recording of Basic Information:
(1) For enterprises in this province, the relevant departments of the housing and urban-rural development system at the place where the enterprise is registered shall record them based on information such as qualifications, licenses, and filings, as well as the relevant materials they possess.
(2) Enterprises entering Hebei Province shall be recorded by the Provincial Department of Housing and Urban-Rural Development based on the relevant materials it has.
(3) The registered practitioners shall be recorded by the Provincial Department of Housing and Urban-Rural Development based on the relevant materials it has.
When the basic information changes, the department that originally recorded the information shall promptly verify and confirm the changed content and modify the original recorded content.
Article 14 Collection and Recording of Information on Good Conduct:
(1) Where any department of the housing and urban-rural development system at or above the county level gives commendation, rewards or titles, the department that made the decision shall record it within 15 days after the decision takes effect officially.
(2) Information on good conduct other than that stipulated in item (1) of this article shall be reported by the industry credit subject to the relevant departments of the housing and urban-rural development system at the same level. After verification and confirmation by the relevant departments, it shall be recorded.
Article 15 Information on bad behavior shall be collected by all levels and departments of the housing and urban-rural development system at or above the county level through the following channels:
(1) Daily supervision of credit entities in the industry;
(2) Law enforcement inspections conducted in accordance with the law;
(3) Verification of reports, complaints about illegal matters of industry credit subjects and matters exposed by the news media;
(4) Administrative penalties, administrative handling and notifications made by the competent department of housing and urban-rural development under The State Council and the competent department of housing and urban-rural development of this province;
(V) Relevant documents of industry social organizations;
(6) The credit information administrative department shall push the credit information shared by all departments.
Article 16 Record of Bad Behavior Information:
(1) Administrative penalties, administrative handling or notifications made by various departments of the housing and urban-rural development system at or above the county level shall be recorded by the making department within 7 days from the effective date of the decision or the date of issuance of the document.
(2) Where the relevant documents of industry social organizations involve information on the bad behaviors of industry credit subjects, the relevant departments of the housing and urban-rural development system at the same level shall be responsible for collecting, summarizing and recording them.
Article 17 When recording credit information, the following materials shall be verified:
(1) Qualification certificates and business licenses issued by administrative authorities;
(2) Approval documents, registration or filing documents of relevant administrative organs;
(3) Certificates or written decisions for commendation, rewards or the awarding of titles;
(4) Administrative penalty decisions, administrative compulsory enforcement decisions and other relevant written decisions (such as notices of order to rectify, notification documents, etc.) made by administrative organs;
(V) Relevant documents of industry social organizations;
(6) A written confirmation document from the department's principal leader.
Article 18 Information on good and bad behaviors shall be permanently preserved and recorded in the credit file of the credit subject. The Department of Housing and Urban-Rural Development of the Province shall set the period for information public display according to their importance. The shortest public display period for bad behavior information such as administrative penalties is 3 months and the longest is 3 years. Among them, the shortest public display period for administrative penalty information in the fields of work safety and fire control is 1 year. The public announcement period for good behavior information is generally three years.
Article 19 Each department of the housing and urban-rural development system at or above the county level shall appoint a specific person to be responsible for the recording of credit information. The personnel responsible for record-keeping shall take the certificates, documents, files and other materials stipulated in these measures as the basis for entry and shall not distort or tamper with the relevant contents.
Article 20 Where an industry credit subject has objections to the recorded credit information, it may submit a written application for verification to the original credit information collection department or the credit information collection department at the next higher level with relevant supporting materials. The original credit information collection department or the superior credit information collection department shall conduct verification within 10 working days from the date of receiving the application, and inform the applicant of the verification result in writing.
If it is verified that the credit information contains errors, the original credit information collection department shall immediately correct them.
Article 21 Where an administrative penalty decision is changed or revoked through administrative reconsideration, administrative litigation or administrative law enforcement supervision, the original credit information collection department shall promptly change or delete the record of such bad behavior.
Article 22 Credit repair shall be carried out in accordance with the process of "Efficient Credit Repair in One Matter" in Hebei Province.
Chapter Four: Credit Information Inquiry and Utilization
Article 23 All levels and departments of the housing and urban-rural development system may query the credit information of industry credit subjects through the information system or the official website of the Provincial Department of Housing and Urban-Rural Development. The public can check the credit information of industry credit subjects through the official website of the Provincial Department of Housing and Urban-Rural Development.
Article 24 The credit information provided for inquiry on the official website of the provincial housing and urban-rural development authority shall include the basic information of the credit subject, information on good behavior, information on bad behavior and other credit records.
Article 25 All levels and departments of the housing and urban-rural development system shall establish a credit reward and punishment mechanism for the construction industry in their daily supervision. They shall use credit information in administrative management work such as administrative licensing, administrative inspection, government procurement, bidding and tendering, government fund allocation, social security, policy support, and commendation and awarding, and expand the application scope of credit evaluation results. Improve the level of public administration and public services.
Chapter Five: Construction of Credit Information System
Article 26 The construction of a credit information system shall comply with the relevant laws, regulations and rules of the state and this province, as well as the requirements of technical standards, and meet the requirements of the national computer information system security classification protection, to ensure the normal operation of the credit information system and the security of credit information.
Article 27 The Department of Housing and Urban-Rural Development of the Province is responsible for the unified planning, research and development, construction, operation, maintenance and management of the credit information system, formulates unified credit information data standards for the entire system, establishes a credit information database including credit files of enterprises (units) and individuals, and formulates system maintenance and management systems.
All departments of the housing and urban-rural development system in cities divided into districts and counties (cities) shall assist in the relevant work of the credit information system construction, be responsible for collecting, recording and using credit information within their administrative regions, and be responsible for the authenticity, accuracy and completeness of the information.
Article 28 All departments of the housing and urban-rural development system at or above the county level shall establish relevant systems to ensure the efficient, convenient, safe and stable operation of the credit information system and the timely and accurate recording of credit information at their respective levels.
Chapter VI Responsibilities and Obligations
Article 29 Industry credit subjects shall truthfully submit relevant credit information and related supporting materials to the credit information collection department and be responsible for the authenticity of the credit information they submit. The credit information collection department shall be responsible for reviewing the authenticity and accuracy of the credit information of credit subjects in the construction industry.
If an industry credit subject submits false credit information, the credit information collection department will record such behavior as a bad behavior.
Article 30 Where the departments of the housing and urban-rural development system at or above the county level, the supervisory and administrative institutions and information technology service institutions entrusted by them and their staff abuse their power, neglect their duties or show favoritism and malpractice in the work of credit information management, they shall be dealt with in accordance with relevant regulations.
Chapter Seven Supplementary Provisions
Article 31 The good behavior information and bad behavior information generated by industry credit subjects since January 1, 2014 shall be included in the scope of credit information collection and recording as referred to in these Measures.
Article 32 The credit evaluation methods for credit subjects in specific industries such as the construction industry, real estate industry, and survey and design industry shall be separately formulated by the Department of Housing and Urban-Rural Development of the Province.
Each city may refer to these measures and formulate credit evaluation methods for enterprises engaged in the maintenance and operation of municipal public facilities in light of local conditions.
Article 33 This measure shall come into effect on June 1, 2025 and remain valid for five years.
