Management Regulations for Industry Standards of Certification and Accreditation
Chapter One General Provisions
Article 1 This Regulation is formulated in accordance with the Standardization Law of the People's Republic of China, the Implementing Regulations of the Standardization Law of the People's Republic of China, the Regulations on Certification and Accreditation of the People's Republic of China, the Measures for the Administration of Industry Standards and other laws and regulations, for the purpose of strengthening the management of industry standards for certification and accreditation, standardizing the formulation and revision of standards, and improving the quality and efficiency of standards.
Article 2 The term "certification and accreditation industry standards" (hereinafter referred to as "certification and accreditation industry standards") as used in these regulations refers to the standards formulated by the Certification and Accreditation Administration of the People's Republic of China (hereinafter referred to as "CNCA") in accordance with its duties for technical requirements that do not have recommended national standards but need to be unified within the national certification and accreditation industry. Industry standards for certification and accreditation include standards related to the foundation of certification and accreditation, accreditation activities, certification activities (excluding product standards), inspection activities, laboratory activities, and other activities of organizations and personnel in the certification and accreditation industry.
The industry standard code for certification and accreditation is "RB".
Article 3 The formulation and management of certification and accreditation standards, including project initiation, drafting, soliciting opinions, technical review, approval, release, filing, assessment and re-examination, shall be governed by these regulations.
Article 4 The Certification and Accreditation Administration of the People's Republic of China is responsible for the unified management of the national certification and accreditation industry standards. The Accreditation and Inspection and Testing Supervision and Administration Department of the State Administration for Market Regulation (hereinafter referred to as the Accreditation and Testing Department) is specifically responsible for undertaking the management of industry standards for certification and accreditation.
Article 5 The formulation of industry standards for certification and accreditation shall follow the principles of fairness, impartiality, openness, transparency and full consultation. It shall be conducive to the scientific and rational utilization of resources, the promotion of scientific and technological achievements in the fields of certification, accreditation, inspection and testing, the improvement of the management level of certification, accreditation, inspection and testing activities, and ensure the scientificity, standardization, timeliness and operability of the standards. Achieve advanced technology and reasonable content.
The formulation of industry standards for certification and accreditation should focus on the demands of strategic emerging fields, key technologies, services and industry management in certification, accreditation, inspection and testing. For emerging technology fields involving integrated development, support should be given to jointly formulating industry standards for certification and accreditation.
Article 6 It is prohibited to stipulate in the industry standards for certification and accreditation matters such as qualifications and licenses, licensing and certification, approval and registration, evaluation and compliance, regulatory entities and responsibilities.
It is prohibited to use industry standards for certification and accreditation to carry out acts that hinder the free circulation of goods and services or exclude or restrict market competition.
Article 7 The entity that approves and issues the certification and accreditation standards shall enjoy the copyright of the standards. Industry standards for certification and accreditation generally do not involve patents. The patents involved should be indispensable for the implementation of the standard, and their management shall be carried out in accordance with the relevant management regulations for patents involved in national standards.
Chapter Two Job Responsibilities
Article 8 The main responsibilities of the Certification and Accreditation Administration of the People's Republic of China are:
(1) Implement the laws, regulations, policies and guidelines on national standardization work, formulate and issue management systems and operational mechanisms for certification and accreditation industry standards, and be responsible for the macro management of certification and accreditation industry standards work;
(2) Be responsible for organizing the formulation of medium and long-term plans for the work of certification and accreditation industry standards and the annual plans for the formulation and revision of certification and accreditation industry standards;
(3) Be responsible for the issuance, approval and release of the project plan for certification and accreditation industry standards.
(4) Organize the establishment of professional technical committees and professional working groups for certification and accreditation industry standards;
(5) Be responsible for formulating the "Detailed Rules for the Formulation and Revision of Industry Standards for Certification and Accreditation" and the "Detailed Rules for the Review of Industry Standards for Certification and Accreditation".
(6) Be responsible for the publicity and promotion of industry standards for certification and accreditation;
(7) Be responsible for establishing an assessment and information feedback mechanism for the implementation of industry standards for certification and accreditation;
(8) Review and decide on major matters concerning the work of industry standards for certification and accreditation.
Article 9 The main responsibilities of the Accreditation Testing Department are:
(1) Be responsible for the implementation of laws, regulations, policies and guidelines on standardization work in the certification, accreditation, inspection and testing industry, organize the drafting of relevant regulations on certification and accreditation industry standards, draft and implement work plans and programs for certification and accreditation industry standards, and establish and improve the certification and accreditation industry standards system;
(2) Be responsible for the daily management of the professional technical committee and professional working groups of certification and accreditation industry standards;
(3) Be responsible for the daily management of the standardization information service platform for the certification and accreditation industry;
(4) Be responsible for organizing the establishment of a talent pool for standardization in the certification and accreditation industry and an expert pool for standard review;
(5) Be responsible for organizing and coordinating the project initiation, drafting, soliciting opinions, technical review, approval, numbering, pre-release review, filing, supervision and inspection, implementation assessment, collection of implementation information feedback, and re-examination of certification and accreditation standards.
(6) Be responsible for undertaking the coordination work with the national standardization work of this industry and the standardization work of other industries.
(7) Be responsible for organizing and conducting training, publicity, implementation and promotion of certification and accreditation standards;
(8) Be responsible for undertaking other work related to the management of industry standards for certification and accreditation.
Article 10 The technical support institutions, upon the entrustment of the Accreditation and Testing Department, undertake the technical review work of relevant industry standards for certification and accreditation. The main conditions and requirements are:
(1) Enterprises, institutions or unincorporated organizations that are lawfully established within the territory of China and have independent legal person status;
(2) Possess strong technical capabilities and industry influence;
(3) Have more than five consecutive years of experience in standardization work, and have led the drafting of one or more international standards, two or more national standards, three or more industry standards or group standards;
(4) Be capable of providing the necessary funds and office conditions for carrying out the entrusted work;
(5) Be capable of carrying out work in accordance with the entrusted matters;
(6) Other requirements as prescribed by the Certification and Accreditation Administration of the People's Republic of China.
Article 11 The main conditions and requirements for the undertaking units of certification and accreditation industry standards are:
(1) Enterprises, institutions or unincorporated organizations that are lawfully established within the territory of China and have independent legal person status;
(2) Have completed at least three or more standard formulation and revision works, and possess a research foundation in the relevant field;
(3) Possess the technical strength, human resource guarantee, financial guarantee, research and development conditions, and working environment required to complete the formulation and revision of standards;
(4) Be responsible for the standard formulation work of the certification and accreditation industry standard formulation and revision projects undertaken.
(5) Be responsible for the promotion and implementation of the certification and accreditation standards undertaken, etc.
(6) Other requirements as prescribed by the Certification and Accreditation Administration of the People's Republic of China.
Chapter Three Project Initiation, Formulation and Revision
Article 12 The Certification and Accreditation Administration of the People's Republic of China shall publicly solicit suggestions for the formulation and revision of one to two batches of industry standards for certification and accreditation each year. Units and administrative departments that meet the requirements of Article 11 May all propose project initiation suggestions for the formulation and revision of industry standards for certification and accreditation.
Article 13 The industry standards for certification and accreditation applied for project initiation shall meet the following requirements:
(1) Comply with the requirements of national laws and regulations;
(2) It falls within the scope of the "Reply on the Scope of Centralized Management of Industry Standards for Certification and Accreditation" issued by the Standardization Administration of the People's Republic of China;
(3) It shall not be duplicated with the national standard and industry standard plan projects that have already been approved.
(4) Comply with other relevant requirements of the Certification and Accreditation Administration of the People's Republic of China.
Article 14 The circumstances for applying for project approval are:
(1) Units that meet the requirements of Article 11 May, in accordance with relevant national development plans and the needs of economic and social development, submit project initiation suggestions to the Certification and Accreditation Administration of the People's Republic of China.
(2) If the implementation effect of a group standard is good and it meets the requirements for the formulation of industry standards for certification and accreditation, the group standard issuing body may apply to convert it into an industry standard for certification and accreditation.
(3) For international standards or international technical documents that are needed by the industry and have no corresponding standardization technical committee to convert into national standards, if they comply with the copyright policies of relevant international organizations and have been approved by the Chinese member bodies of the International Organization for Standardization, they can be converted into industry standards for certification and accreditation.
(4) For standards urgently needed for the management and business development of certification, accreditation, inspection and testing, the Certification and Accreditation Administration of the People's Republic of China may suggest that relevant units with previous research foundations and scientific research achievements organize the proposal for project initiation.
(5) In emergency situations where the Certification and Accreditation Administration of the People's Republic of China deems it feasible to initiate a project.
Article 15 The technical support institutions entrusted may undertake the review work for the project initiation of industry standards for certification and accreditation.
Article 16 The Certification and Accreditation Administration of the People's Republic of China shall, based on the review conclusions, formulate and revise plans for the formulation of industry standards for certification and accreditation, and issue them after approval.
Article 17 After the plan for the formulation and revision of the certification and accreditation industry standard project is issued, if any of the following circumstances occur, the undertaking unit of the certification and accreditation industry standard may apply to the Certification and Accreditation Administration of the People's Republic of China for adjustment or cancellation of the project:
(1) If the project needs to change its name, replace the person in charge, or extend the completion time, etc., the undertaking unit of the certification and accreditation industry standard may apply to the Certification and Accreditation Administration of the People's Republic of China for project adjustment.
(2) If a national standard or industry standard with the same or similar content as the certification and accreditation industry standard project has been released, the undertaking unit of the certification and accreditation industry standard may apply to the Certification and Accreditation Administration of the People's Republic of China for the revocation of the project.
(3) If the requirements for certification and accreditation work change and it is impossible to complete the formulation and revision of industry standards for certification and accreditation by adjusting the technical content of the project, the undertaking unit of the industry standards for certification and accreditation may apply to the Certification and Accreditation Administration of the People's Republic of China for the revocation of the project.
Article 18 Where the Certification and Accreditation Administration of the People's Republic of China discovers during the implementation of the plan for the formulation and revision of industry standards for certification and accreditation that it is necessary to adjust or revoke a project in accordance with the law, such adjustment or revocation shall be made.
Article 19 The formulation cycle of industry standards for certification and accreditation generally shall not exceed 24 months, and the revision cycle generally shall not exceed 18 months. In case of special circumstances requiring an extension, a written application should be submitted 30 days in advance and approved by the Certification and Accreditation Administration of the People's Republic of China. The extension generally shall not exceed twelve months.
Article 20 The units undertaking the formulation and revision of industry standards for certification and accreditation shall widely solicit opinions from relevant parties, organize investigations, analyses, experiments and arguments on matters related to the standards, and form the draft for soliciting opinions and the compilation explanation of the industry standards for certification and accreditation.
The draft for soliciting opinions on the formulation and revision of certification and accreditation standards and the compilation explanation should be made public for soliciting opinions from the society, and the period should be no less than 30 days.
The undertaking units of industry standards for certification and accreditation shall solicit opinions from all stakeholders before or simultaneously, and the period shall be no less than 30 days.
Article 21 The undertaking units of the industry standards for certification and accreditation shall summarize and study the opinions of the public, form the draft for review of the industry standards for certification and accreditation, and submit it to the Accreditation and Testing Department for technical review.
The technical support institution entrusted may undertake the review work of the draft for submission of the industry standard for certification and accreditation.
Article 22 After the draft for review passes the examination, the undertaking unit of the certification and accreditation industry standard shall form the draft for approval and submit it to the Accreditation and Testing Department within 60 days.
Chapter Four Approval, Release and Filing
Article 23 The Certification and Accreditation Administration of the People's Republic of China is responsible for the examination, approval and numbering of the materials submitted for approval, and for their announcement and release.
Article 24 The number of the certification and accreditation industry standard shall consist of the code of the certification and accreditation industry standard, the code of the standard attribute, the sequence number and the year number.

Article 25 After the release of the industry standard text for certification and accreditation, if minor adjustments, supplements or deletions are required based on actual needs, they shall be modified by way of a modification sheet. The amendment is proposed by the undertaking unit of the certification and accreditation industry standard, and after being approved by the Certification and Accreditation Administration of the People's Republic of China in accordance with the procedures, it is released in the form of an announcement. The amendment has the same validity as the standard.
Article 26 Within 60 days from the date of approval and release of the certification and accreditation industry standard, and before the implementation date of the standard, it shall be filed with the administrative department for standardization under The State Council through the National Standard Information Public Service Platform and other means.
Chapter Five Implementation, Review and Supervision
Article 27 The Certification and Accreditation Administration of the People's Republic of China shall make full use of multiple channels such as newspapers, television, the Internet and on-site meetings to carry out publicity and promotion work on the industry standards for certification and accreditation, provide interpretation and business guidance on the industry standards for certification and accreditation, enhance the understanding of the industry standards for certification and accreditation among all sectors of society, and promote the effective implementation of the industry standards for certification and accreditation.
Article 28 Any natural person, legal person or unincorporated organization may submit written opinions and suggestions to the Certification and Accreditation Administration of the People's Republic of China regarding problems existing in the review and supervision of industry standards for certification and accreditation.
Article 29 Encouragement is given to relevant legal persons and unincorporated organizations to actively adopt industry standards for certification and accreditation when participating in the formulation of laws and regulations, as well as in activities such as system construction, certification and accreditation, inspection and testing, government procurement, and bidding and tendering. Encourage the promotion of standardized production methods, experiences, management concepts and service models.
Article 30 Three years after the implementation of the industry standards for certification and accreditation, the Accreditation and Testing Department shall organize an evaluation of the implementation effect of the industry standards for certification and accreditation, including the implementation status, benefits achieved, existing problems and improvement suggestions. Encouragement and experience promotion should be given to certification and accreditation industry standard projects, organizations and individuals that have made substantive contributions or achieved remarkable benefits in promoting the innovative development of strategic emerging industries and key core technologies.
For representative typical cases, they should be further promoted and applied to give full play to their exemplary and leading role.
Article 31 Within five years of the implementation of the industry standards for certification and accreditation, the Accreditation and Testing Department shall organize a review of the industry standards for certification and accreditation. Where any of the following circumstances occurs, a timely review shall be conducted:
(1) Where there are major changes in laws, administrative regulations, departmental rules or relevant state provisions;
(2) Where there are significant changes in relevant international standards, national standards or industry standards;
(3) Major changes occur in key technologies and applicable conditions;
(4) Other circumstances that require timely review.
Article 32 The review conclusion shall be divided into three situations: remaining valid, revision and abolition. The Certification and Accreditation Administration of the People's Republic of China shall promptly announce the conclusion of the re-examination.
The review conclusion is that the revised industry standard for certification and accreditation shall be revised by the Certification and Accreditation Administration of the People's Republic of China in accordance with relevant procedures.
For certification and accreditation industry standards whose re-examination conclusion is to be abolished, the Certification and Accreditation Administration of the People's Republic of China shall solicit public opinions before the announcement of abolition.
Article 33 It is prohibited for the undertaking units of certification and accreditation industry standards to charge fees for profit. It is strictly prohibited to collect unreasonable fees by means of levies or paid signatures. If prohibited behavior is verified, the qualification for formulating and revising industry standards for certification and accreditation will be revoked.
Article 34: For legal persons and unincorporated organizations that fail to complete the formulation and revision of industry standards for certification and accreditation on time without justifiable reasons, and the units and project leaders that still fail to complete the formulation and revision of industry standards for certification and accreditation after being urged, their qualifications to undertake such projects shall be revoked and they shall not be allowed to apply for new projects within three years.
Article 35: Legal persons and unincorporated organizations that violate these regulations shall be punished in accordance with the Standardization Law of the People's Republic of China, the Implementing Regulations of the Standardization Law of the People's Republic of China and other relevant laws and regulations.
Chapter VI Supplementary Provisions
Article 36 The Certification and Accreditation Administration of the People's Republic of China shall make the industry standards for certification and accreditation free of charge to the public.
Article 37 The Certification and Accreditation Administration of the People's Republic of China is responsible for the interpretation of these regulations.
Article 38 These regulations shall come into effect as of the date of promulgation. The "Work Procedures for the Formulation (Revision) of Industry Standards for Certification and Accreditation" (Guo Ren Ke [2018] No. 15) shall be simultaneously abolished.
